Artist Release: I, the artist, warrant and represent that I am the sole legal owner of all rights, titles and interests in all Artwork, including all related intellectual property interests such as trademarks and the sole and exclusive copyright in all artworks, and have the full right and authority to enter this Agreement and grant the rights granted in this Agreement. Photography Release: Water Street Studios is also a private event space. Your artwork may or may not appear in photographs or videos taken during WSS events and/or private event rentals. WSS may also photograph the gallery shows in whole or in part for advertising purposes. By agreeing to this waiver, you acknowledge and agree to not hold WSS responsible for the content or distribution of photos/videos taken during events and acknowledge your artwork may appear in future WSS advertising. Gallery Commission: Artwork sold during the run of show is subject to a 40% commission to Water Street Studios. WSS Resident Artists, Clay Makers, School of Art Instructors and Artist Collective Members are subject to a 30% commission. All sales must be made through WSS. Exhibiting artists will receive their percentage of sales commission no later than two weeks after the show ends. WSS will file applicable sales tax. Artists must submit a W9 required tax information prior to receiving payment. Insurance and Waiver of Liability: I do hereby expressly release and hold harmless WSS and all its staff, volunteers and representatives, individually and collectively, from all liability for all damages to or for the loss of the Artwork that I am voluntarily submitting. If WSS determines that a piece of art is damaged and may be eligible for coverage under its insurance policy, the organization will work with you to determine the best course of action. WSS is not responsible for any damage not covered by its insurance policy, including applicable deductible, amount above the maximum insurance, or a denied claim. This coverage only applies to items on display in the galleries. Artwork not retrieved at the designated pick-up date is not covered by insurance. Pickup: Artwork must be picked up promptly on the scheduled pick-up day. If the artist is unable to make the pick-up day, it is their responsibility to contact WSS (gallery@waterstreetstudios.org) to reschedule. Unsold art remaining at the gallery after the designated pick-up deadline will be charged a $5 daily storage fee unless advance arrangements have been made. Artwork left after 30 days becomes the property of WSS. Artwork not picked up at the designated pick-up date is not covered by insurance therefore Water Street Studios is not responsible for or liable if damage occurs.
